Can You Buy Kratom in Florida?
Yes — kratom is legal in Florida for adults 21 and older.
But there are two things you need to know before you buy:
- Sarasota County has a local ban. Kratom is fully illegal there regardless of state law.
- 7-OH products are now illegal statewide. A concentrated kratom compound was classified as Schedule I in August 2025. Standard kratom products are unaffected.
If you’re outside Sarasota County and buying natural kratom, you’re in the clear.

Kratom Age Requirements in Florida
Florida law sets the minimum purchase age at 21.
Selling, delivering, or providing kratom to anyone under 21 is a second-degree misdemeanor — punishable by up to 60 days in jail and a $500 fine. This applies to both in-store and online purchases.
Vendors are required by law to verify age before completing a sale. For online orders, that means ID verification before the first delivery.
The 2023 Florida Kratom Consumer Protection Act
Before 2023, Florida had no specific kratom regulations.
A series of ban attempts between 2016 and 2022 failed in committee.
In 2023, that changed.
Governor Ron DeSantis signed CS/HB 179 on June 2, 2023 — establishing Florida as a regulated kratom state under Chapter Law 2023-182, codified at §500.92, Florida Statutes.
The Department of Agriculture and Consumer Services (DACS) was designated as the administering and enforcement agency.
What the 2023 Kratom law covers:
- Minimum purchase age of 21
- Definition of “kratom product” in state statute
- Criminal penalties for age restriction violations
- Food safety standards under DACS oversight
What it doesn’t cover — a more comprehensive companion bill (SB 136) with processor registration, alkaloid content labeling, and mandatory third-party testing didn’t make it into the final law.
Those provisions have been reintroduced in every session since without passing. Florida’s KCPA is a foundation, not a finished structure.
ANA voluntarily applies testing and labeling standards that go beyond what Florida currently requires.

The 7-OH Ban — What Happened and Where It Stands
This is the most significant development in Florida kratom law since 2023 — and most vendors haven’t updated their pages to reflect it accurately.
What is 7-OH? 7-hydroxymitragynine (7-OH) is an alkaloid that occurs naturally in kratom leaves at trace concentrations. Isolated and concentrated forms were sold separately as extracts, shots, and powders — often at much higher potency than standard kratom.
What changed in August 2025? On August 13, 2025, Florida Attorney General James Uthmeier issued an emergency rule classifying isolated and concentrated 7-OH as a Schedule I controlled substance — placing it in the same legal category as heroin and fentanyl analogs. The rule took effect immediately.
This was an executive action, not legislation. HB 1489 — a bill that would have capped 7-OH at 2% of the alkaloid fraction — had died in committee in June 2025.
Was it challenged? Yes. Two businesses and six users filed a challenge at the Division of Administrative Hearings. An administrative law judge upheld the ban in December 2025. Bills to make the Schedule I classification permanent through legislation were filed in both chambers for the 2026 session.
Does this affect standard kratom products? No. Natural kratom containing 7-OH at its normally occurring trace levels is unaffected. The ban applies specifically to isolated and concentrated forms. ANA does not ship 7-OH products to Florida.
Sarasota County — The One Local Ban
Sarasota County is the only jurisdiction in Florida where natural kratom itself is banned.
The county passed Ordinance No. 2014-035 in January 2014 — nine years before Florida enacted the KCPA — classifying kratom as a “designer drug” under Sec. 62-351 of the Sarasota County Code of Ordinances.
What the ban means in practice:
- Possession, sale, purchase, and use are all prohibited within county limits
- Violations are a misdemeanor: up to 60 days in jail, $500 fine, mandatory court appearance
- The 2023 state KCPA did not preempt this local ordinance
- You cannot legally possess kratom purchased elsewhere once you enter Sarasota County
ANA does not ship to Sarasota County addresses.
Other Florida Counties — What to Know
No other Florida counties have enacted kratom bans — but two situations are worth flagging.
St. Johns County (2019) — proposed ban rejected. A county drug task force lobbied for a ban. After public testimony from roughly 20 kratom users at a commission meeting, commissioners unanimously declined to pursue the ordinance.
Manatee County (2025) — watch status. In September 2025, commissioners voted 4-3 to direct staff to draft an ordinance modeled on Sarasota’s. No final vote had been scheduled as of this writing. ANA will update this page if the ordinance advances.

Frequently Asked Questions
Yes. Miami-Dade, Orange, and Hillsborough counties have no local kratom restrictions. Florida’s KCPA applies statewide and no municipalities outside of Sarasota County have enacted local bans.
Yes — with one exception. Carrying kratom into Sarasota County is illegal regardless of where you purchased it. Ignorance of local law is not a valid defense there.
Standard kratom is not a controlled substance. It is regulated as a food product under DACS. Isolated and concentrated 7-hydroxymitragynine (7-OH) was classified Schedule I by AG emergency rule in August 2025 — but this does not affect conventional kratom products.
The Florida KCPA (2023 legislation) regulates kratom commerce — age limits, labeling, enforcement. The 7-OH ban (2025 AG emergency rule) is a separate executive action that specifically targets isolated and concentrated 7-OH as a Schedule I drug. They operate independently.
