What Arizona's Kratom Consumer Protection Act Requires
Arizona’s KCPA is codified under Arizona Revised Statutes §§ 36-795 to 36-795.03. It regulates kratom as a food and dietary ingredient rather than a controlled substance — placing oversight with the Arizona Department of Health Services rather than law enforcement.
Product Standards
Under A.R.S. § 36-795.02, a processor or retailer may not prepare, distribute, sell, or expose for sale any kratom product that:
- Is adulterated with a dangerous non-kratom substance that affects the product’s quality or strength to the degree it could injure a consumer
- Is contaminated with a poisonous or deleterious non-kratom substance, including any controlled substance
- Contains 7-hydroxymitragynine in excess of 2% of total alkaloid composition
- Contains any synthetic alkaloid, including synthetic mitragynine, synthetic 7-OH, or any other synthetically derived kratom compound
- Does not include a label disclosing the amount of mitragynine and 7-hydroxymitragynine in the product
Age Restrictions
No processor or retailer may distribute, sell, or expose for sale a kratom product to anyone under 18 years of age. Retailers are expected to verify age through government-issued identification.
Labeling Requirements
All kratom products sold in Arizona must be properly labeled. Labels must include:
- The amount of mitragynine contained in the product
- The amount of 7-hydroxymitragynine contained in the product
- Ingredients and a suggested serving size
2022 Amendment — HB 2601
n May 2022, Governor Doug Ducey signed HB 2601, which amended the original KCPA by updating kratom product definitions, adding contamination standards, and expanding enforcement authority under ARS §§ 36-901 to 36-980 — the state’s pure food statutes.
This gave ADHS broader tools to take action against non-compliant products and vendors.
Penalties for KCPA Violations in Arizona
Arizona does not treat kratom possession or personal use as a criminal matter. Kratom is not listed under the Arizona Uniform Controlled Substances Act.
However, dealers — processors and retailers — who violate the KCPA face:
- Class 2 misdemeanor for violations of the product standards or age restriction provisions under A.R.S. § 36-795.03
- Civil liability for economic, noneconomic, or consequential damages to consumers harmed by non-compliant products
- Regulatory action by ADHS, including product seizures, fines, and potential business closure for serious or repeated violations
A Class 2 misdemeanor in Arizona carries up to 4 months in jail and a fine of up to $750.
Arizona's Approach: Regulation Over Prohibition
Arizona’s decision to regulate rather than ban reflects a broader philosophy that was relatively uncommon when HB 2550 passed in 2019.
At the time, several states were actively pursuing Schedule I classification for kratom alkaloids. Arizona went the other direction — treating kratom as a consumer product subject to health and safety standards rather than a controlled substance.
No vendor licensing required. A key structural difference from states like Georgia or Tennessee: Arizona’s KCPA does not require vendors to obtain a special kratom license.
Businesses must comply with general retail regulations and KCPA product standards, but there is no separate registration or licensing system for kratom sellers.
Enforcement is complaint-driven and inspection-based through ADHS rather than through a formal licensing framework.
Enforcement has been inconsistent. One consistent criticism from industry observers is that high-potency products appearing to violate the 7-OH cap have been found in retail locations across the state despite the law being in place since 2019.
The 2022 amendment was partly intended to address this by giving ADHS expanded enforcement authority under the state’s pure food statutes.
